CONTEST DESCRIPTION:

“Follow Fridays for Five” (“Contest”) starts on Friday, February 5^th and ends Friday, February 26, 2010 (the “Contest Period”), unless terminated earlier by Releasees.  The “Follow Fridays for Five” Contest will be conducted as an on air contest on 100.3 the Beat.

ELIGIBILITY RESTRICTIONS:

1. This contest is open to all legal U.S. residents in the Tri State listening area, who are fourteen (14) years of age and older.

1. Participants are eligible to win only one (1) cash contest on WPHI in any ninety (90) day period.

1. Employees, volunteers, interns and agents of WPHI, Radio One, Inc., its affiliates, representatives, subsidiaries and advertising and promotion agencies and each of their respective parent companies, and members of their immediate families (spouse, parents, children, and siblings and their respective spouses and/or life partners) and individuals living in the same households of such persons are ineligible to enter or win.

1. This contest is subject to all applicable federal, state, local laws and regulations.  By participating, entrants agree to be bound by these Official Rules and accept decisions of Radio One, Inc. and the judges as final in all matters relating to this Contest.

EXECUTION:

1. During the Contest Period, in order to win you must have an active Twitter account and be a follower on the 100.3 the Beat Twitter page.

2.   Each Friday between the hours of 10 a.m. and 7 p.m. 100.3 the Beat will post a Twitter message to its followers prompting them to call in. When that Twitter posting is made caller number one (1) at 215-263-1003 will receive a cash prize for correctly identifying and replying to the posting.

3.   After the post is correctly identified by caller number one (1) they will receive a cash prize of $500.00

4.   Winners’ names may be broadcast after they have won the prize of $500.00.  Winners will be required to timely execute and return an Affidavit of Eligibility and Release and IRS Form W-9, and except where prohibited, a Publicity Release and such other documents requested by Releasees (WPHI, Radio One, Inc., subsidiaries, affiliates, representatives, advertising and promotion agencies, and all of their respective parent companies, employees, officers, directors, shareholders, and agents) to vest in Releasees all rights of ownership, including copyright, to permit Releasees and Radio One, Inc. unrestricted use of Winners’ names, in whole or in part, submitted as part of their entries in any and all media or future promotional efforts. Failure to return any requested document within thirty (30) days of receipt will cause prize to be forfeited.  If a prize notification letter is returned or deemed undeliverable, the prize will be forfeited.  All taxes and other expenses incurred are the Winners’ sole responsibility.  No substitution or transfer of prize permitted.

5.   Information supplied by entrants is used only for the purpose of maintaining a database of members of the Loyal Listener Club, for selecting winning entries and to notify winners.  The information will be not be reused, sold or shared in any manner by Releasees without permission.

6.   All decisions made by 100.3 The Beat and WPHI-FM station management staff regarding any aspect of this contest are final.

7.   WPHI and Radio One, Inc. retain the right to disqualify any contestant if all contest rules are not followed.

8.   So long as no participant is materially adversely affected, WPHI and Radio One, Inc. reserve the right to make changes in contest rules, which will become effective upon bring announced on the air.

PRIZE:

1. Contest winners who correctly identify the “Follow Fridays for Five” posting during the contest period will be awarded a cash prize of $500.00.

2.  Winners must be provide valid identification (i.e. via driver’s license, passport or other photo I.D.)               to claim prize.

LEGAL CONDITIONS:

1. By participating, entrants:

(a)    agree to these Official Rules and the decisions of the Releasees which shall be final in all respects;

(b)    agree to release WPHI, Radio One, Inc., and its subsidiaries, affiliates, representatives, and advertising and promotion agencies, their respective directors, officers and employees from any and all liability for any injuries, losses or damages of any kind caused by their participation or resulting from acceptance, possession, use, or misuse of the prize; and

(c)    acknowledge that said parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the prize including, but not limited to, its quality.

1. Noncompliance with the Official Rules will result in disqualification.

1. By participating, entrants agree to irrevocably assign and transfer all rights, title and interest in and to the entry, including but not limited to, copyrights to Radio One, Inc.

1. WPHI, Radio One, Inc, its affiliates, representatives, subsidiaries and advertising and promotion agencies and each of their respective parent companies, subsidiaries, affiliates, representatives, advertising and promotion agencies, and all of their respective employees, officers, directors, shareholders, and agents (collectively  “Releasees”) are not responsible for any human error, mistakes, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any Web site or online service, representations made by any affiliate stations, or any other error or malfunction.  Entry materials that have been tampered with or altered are void.  Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by Radio One, Inc. or its agents.

1. WPHI and Radio One, Inc. are not responsible for the inability of any contestant to complete or continue a telephone call an internet registration or facsimile transmission due to service outages, delays, busy signals, equipment malfunctions, or any other technical difficulties.  In addition, WPHI, Radio One, Inc., their representatives, agents, and employees are not responsible for lost, misdirected, garbled transmissions or incomplete entries.

1. Payment of all federal, state and local taxes is the sole responsibility of the winner. Winners may be required to sign an IRS form or the equivalent if the retail value of the prize is $600.00 or greater.

1. Once submitted, all contest entries become the property of the WPHI and will not be returned. This includes any submission of materials, mail-in, point-of-sale registration, and any other contest entries required.

1. No purchase is necessary to participate.  The contest is void where prohibited.  This contest is subject to all applicable federal, state, and local laws and regulations.

1. Odds of winning depend on the number of eligible contestants participating in the contest.

1. Winner acknowledges that WPHI and Radio One, Inc. have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to items included in the grand prize package, including but not limited to the quality, merchantability, habitability, mechanical condition or fitness of prize items.

1. Winners are responsible for the payment of taxes on prizes and for any other expenses relating to use of prizes.

1. LIMITATIONS:  Releasees are not responsible for any typographical or other errors in printing, the offering or administration of the Contest, or in the announcement, awarding or acceptance of prizes.  Releasees have no liability whatsoever for any injuries, losses, or damages of any kind resulting from acceptance, possession, use or misuse of the prize or participation in this Contest (including, without limitation, any travel related hereto).  All trademarks are used herein for identification purposes only, and are the property of their respective owners.

1. By their participation in the contest, winners consent to the use of their name, voice, print material and/or photograph in any media now known or hereafter devised for promotional purposes, including online announcements, without additional compensation, except where prohibited by law and will need to sign a publicity release form.  Entrants agree that their entry will be owned by Radio One, Inc. and its designees shall have the right to publish, use, adapt, edit and/or modify such entry in any way including in commerce and in any and all media worldwide, including but not limited to the Internet, without limitation and without compensation to the entrant.  Entrants represent that their entries, and the Releasees use thereof, will not infringe upon the rights of any third parties.

1. WPHI and Radio One, Inc., its subsidiaries, its affiliated advertising agencies, participating sponsors/promotional partners, other radio stations in the Philadelphia Metropolitan area will not assume any responsibility for any changes in the execution of the contest, including cancellation of the contest, as a result of the occurrence of events not within the control of WPPZ or Radio One, Inc., such as Acts of God, strikes, terrorists’ acts or criminal acts by third parties.
