Cases stall due to non-compliance with legal subpoena requirements since missing or defective service can undermine the subpoena, and overbroad or improper demands invite objections. Failure to follow objection and compliance procedures also creates delays, and enforcement problems can push the case further off schedule.

According to the United States Courts, in 2025, there were 32,827 cases pending in the US Courts of Appeals and 398,121 cases pending in US District Courts. There are many reasons why cases stall, but in many cases, it’s because there’s non-compliance with legal subpoena requirements.

Can Missing or Defective Service Undermine the Subpoena?

When serving a subpoena, it must be done correctly and in accordance with the applicable procedural rule. In general, courts need reliable proof that the witness actually received the subpoena and that the correct person or entity was served.

If those requirements are overlooked, the recipient may challenge the subpoena rather than comply with it. That can lead to:

  • Motions
  • Hearings
  • Re-service
  • Additional deadlines

This makes it important for attorneys to verify service requirements and use something reliable like this Serve Index New Jersey subpoena guide.

Overbroad or Improper Demands Invite Objections

A subpoena can create delays when it demands more than the applicable rules allow. For example, it may be challenged if it:

  • Doesn’t provide reasonable time to comply
  • Exceeds geographical limits
  • Seeks privileged information
  • Imposes an undue burden

Once an objection is raised, the requesting party may need to negotiate narrower terms for the subpoena documents or seek a court order compelling compliance. That process can consume valuable time, especially when the requested witness or records are central to a case.

Does Failure to Follow Objection and Compliance Procedures Create Delays?

Non-compliance doesn’t always mean a witness is simply refusing to cooperate. A recipient may have procedural rights to object, seek protection, or request that a subpoena be modified.

Under Rule 45objections generally must be served before the specified compliance date or within 14 days of service, whichever is earlier. If the parties don’t resolve the dispute, then the requesting party may need to ask the court for an order compelling production. As a result, this can pause access to evidence while the court determines whether the subpoena is valid and what compliance should require.

Enforcement Problems Can Push the Case Further Off Schedule

When a properly issued deposition subpoena is ignored, enforcement may become necessary, and this adds another procedural stage before the underlying case can move forward. It requires the requesting side to demonstrate that the subpoena was validly issued, though, and that the recipient failed to comply.

In some proceedings, a party seeking enforcement has to submit documentation establishing service and the alleged failure to obey. This means that poor recordkeeping or procedural mistakes can weaken an otherwise legitimate enforcement effort.

Non-Compliance With Legal Subpoena Requirements Can Cause Delays

Compliance is of the utmost importance in cases, as just one wrong move regarding a legal subpoena can cause delays. It’s important to know the laws of local jurisdictions ahead of time so you’re prepared.
